Public and products

The Public Liability insurance policy covers the University's legal liability to pay compensation in respect of, personal injury to non staff members and damage to a third party's property.

This policy also covers the legal liability of any person acting on instruction from or on behalf of the University. e.g. staff, students, volunteer workers.

The Product Liability insurance policy covers the University's legal liability to pay compensation to a third party in respect of claims arising from the manufacture and/or sale of goods or products.

The following products are excluded unless specific notification has been given to the insurer:

  • Pharmaceuticals of every description
  • Herbicides and pesticides
  • Products to promote growth or control diseases in growing crops or plants
  • Stockfeed products other than primary grown products to be used for such purposes
  • Explosives
  • Fireworks
  • Ammunition and armaments
  • Medical Equipment for direct application to the person
  • Human implants
  • Surgical, optical or ophthalmic instruments
  • Lead products

Liability claims

It is vitally important that incidents (e.g. an accident involving a visitor to the University) which could give rise to a claim in the future are advised immediately to Audit and Risk Management to enable the correct procedures to commence.

It is feasible that a statement of claim in the Supreme Court could be received up to seven years after the event and that witnesses' memories are dimmed by the passage of time. Therefore, immediate notification will give Audit and Risk Management the opportunity to take statements from witnesses whilst the incident is still fresh in their minds.

Immediately following the occurrence of an incident that may give rise to a claim, the following should be undertaken:

  1. All reasonable steps should be taken following an incident to protect the person or property from further injury or damage.
  2. Advise Audit and Risk Management of the incident.
  3. Any correspondence received from third parties should be forwarded to Audit and Risk Management for reply.
  4. No persons should give an interview or make any statement to a Loss Assessor who is not acting on behalf of the University's insurers.
  5. No correspondence should be entered into with the third party
    that may indicate liability on behalf of the University.
